During the 1950s, O’Donoghue & O’Donoghue helped to establish some of the first jointly administered benefit plans in the construction and printing industries.
Since then, a substantial amount of the firm’s practice has been devoted to representing national, regional and local employee benefit plans, including both defined benefit and defined contribution pension, 401(k), medical, vacation, apprentice and other welfare plans. Today, the firm represents more than 100 such plans ranging in size from fewer than 100 participants to more than 100,000 participants. Plans represented by O’Donoghue have assets ranging from one million dollars to fifteen billion dollars.
The plans represented by O’Donoghue & O’Donoghue LLP are primarily Taft-Hartley, jointly-trusteed, multiemployer plans and Union staff plans, all of which are governed by the Employee Retirement Income Security Act (ERISA). Although the Firm has represented most of its employee benefit clients on an ongoing basis, over many years and decades, the Firm has also been retained to represent plans on an ad hoc basis where special expertise has been required, such as responding to government audits or possible plan disqualification, or addressing complex fiduciary issues.
O’Donoghue & O’Donoghue LLP provides a full range of services to our clients, including drafting and amending plans, assuring the ongoing tax qualified status of plans, preparing summary plan descriptions and summaries of material modifications, keeping trustees advised with respect to changes in statutes, regulations and case law, providing opinions with respect to fiduciary issues, drafting or reviewing contracts with investment managers and other service providers, defending the trustees in litigation, and pursuing delinquent contributions owed to the plans.
